BUL — Terms of Service

Last updated: October 9, 2026

1. What this agreement covers

BUL is operated by Avi Friman. Contact: support@friman.app.

  1. BUL is an Email API service for transactional email and campaigns, with a dashboard, delivery reporting and webhooks, at bul.friman.app.
  2. These terms apply to anyone who opens an account or uses the service (the "customer"). Opening an account and accepting the terms at sign-up means agreeing to these terms, the Privacy Policy and the Acceptable Use Policy.
  3. The service is intended for businesses, organisations and developers acting in a business capacity.
  4. A Data Processing Addendum (DPA) and the full list of subprocessors are available on request at support@friman.app.

2. Account

  1. Whoever signs up confirms they are at least 18 and authorised to bind the organisation they sign up for.
  2. Account details must be accurate and kept up to date.
  3. The customer is responsible for keeping login details and API keys safe, and for everything done with them. If unauthorised use is suspected, revoke the key immediately and tell BUL.
  4. BUL may ask to verify identity, the business or domain ownership, and may refuse to open an account or to allow a particular use.

3. The service

  1. BUL hands messages to the recipients' mailbox providers. Whether a message reaches the inbox, the spam folder or is rejected is decided by the recipient's mailbox provider. BUL does not guarantee delivery or inbox placement.
  2. BUL may change the service and its features. On a paid plan, a capability the customer paid for will not be materially reduced without notice under section 5.
  3. Features marked "beta" or "experimental" are provided as they are and may change or be discontinued.
  4. The service is subject to rate limits, quotas and protection mechanisms, as described in the documentation and the dashboard.

4. Lawful sending

  1. The customer sends only in line with the Acceptable Use Policy and the law that applies to it, including mailing, advertising and privacy law.
  2. The customer is responsible for message content, recipient lists and the legal basis for sending — including consent for advertising where required, marking messages as advertising ("פרסומת") where Israeli law requires it, sender identification and a way to unsubscribe.
  3. BUL's automatic protections — suppressing addresses that bounced, complained or unsubscribed, slowing down and pausing — are part of the service. They do not shift the customer's responsibility to BUL.

5. Plans, prices and changes

  1. Free plan. BUL may change, reduce, pause or end the free plan and its limits, including closing it to new sign-ups based on capacity. Where practical, we will give notice in advance.
  2. Security, abuse and reputation. BUL may introduce or change protections and limits immediately, without prior notice, when there is a risk to the service, other customers, recipients or mailbox providers. This applies to all plans.
  3. Paid plans (once offered):
    • The price and quotas are set out on the pricing page or in the order.
    • A price change, or a materially adverse change to a plan, will not apply to a period already paid for. It applies from the next billing cycle, after notice by email and in the dashboard at least 30 days in advance.
    • A customer who does not accept the change may cancel before it takes effect, at no extra charge.
  4. Payment, renewal, cancellation and refund terms for paid plans will be set out on the pricing page and in the order, subject to applicable law.

6. Data and privacy

  1. The Privacy Policy explains what data BUL keeps, why, for how long and who it is shared with.
  2. Data the customer sends through the service — message content and recipient data — is processed by BUL on the customer's behalf and on its instructions.
  3. BUL may use data generated in the service, to the extent needed, to operate and secure the service, prevent abuse and protect deliverability.
  4. BUL does not sell customer or recipient data, and does not use message content to train AI models.

7. Suspension, termination and account deletion

  1. BUL may suspend or restrict an account or a send under the Acceptable Use Policy:
    • when there is real or immediate risk — at once and without notice;
    • in other cases — where practical, after notice and a chance to fix the problem.
  2. BUL may terminate the agreement:
    • immediately, for a serious breach or a breach that was not fixed;
    • without cause, on 30 days' notice. On a paid plan, the unused portion is then refunded pro rata.
  3. The customer may stop using the service at any time. Account deletion is done by the account owners from the dashboard (Settings → Delete account):
    • the account is frozen immediately;
    • there are 7 days to cancel;
    • after that, the data is deleted from active systems, and in any case within 30 days of the request;
    • an email is sent when the request is received, and another when deletion is complete;
    • what is kept after deletion, and why, is set out in the Privacy Policy.
  4. Sections that by their nature continue after termination — such as liability, indemnity, accrued payments and governing law — survive.

8. Intellectual property

  1. The service, code, documentation and the "בול" / BUL brand belong to BUL.
  2. Content the customer sends belongs to the customer. The customer allows BUL to process it as needed to provide and secure the service and to prevent abuse.
  3. The official library, bul-email, is distributed under the MIT licence, on that licence's terms.
  4. BUL may use feedback the customer sends.
  5. BUL will use the customer's name or logo in its marketing only with the customer's explicit consent.

9. "As is" service

The service is provided "as is" and "as available". BUL makes reasonable efforts towards high availability and security, but does not commit to uninterrupted availability, delivery or error-free operation unless agreed in writing.

10. Limitation of liability

  1. Subject to applicable law, BUL is not liable for:
    • indirect or consequential damage;
    • loss of profits, revenue, goodwill or data;
    • damage caused by a recipient's mailbox provider or an external infrastructure provider;
    • damage caused by the actions or omissions of the customer or its recipients;
    • damage caused by a protection applied to preserve deliverability.
  2. Subject to applicable law, BUL's total liability to the customer is limited to the amount the customer paid BUL in the 12 months before the event giving rise to the claim.
  3. The limitation does not apply to damage caused wilfully or by gross negligence, or to anything the law does not allow to be limited.

11. Indemnity

The customer will indemnify BUL for any loss, cost or third-party claim that arises from:

  • the customer's message content or lists;
  • the absence of a legal basis for sending;
  • a breach of these terms or of the Acceptable Use Policy.

Third parties include recipients, authorities and mailbox providers. This applies provided BUL notifies the customer of the claim promptly and allows it to defend.

12. Changes to these terms

  1. BUL may update these terms.
  2. Material changes will be announced by email and in the dashboard at least 30 days before they take effect. A customer who does not agree may cancel before the change takes effect.
  3. Changes required by law, or made for security and abuse prevention, may take effect sooner.
  4. Changes to a paid plan are also subject to section 5.3.
  5. Every previous version of this document is available in the version history. BUL records which version each user accepted, and when.

13. Governing law and jurisdiction

This agreement is governed by the laws of the State of Israel. The competent courts in Israel have exclusive jurisdiction.

14. General

  1. BUL may transfer this agreement to another entity as part of a merger, sale or reorganisation, with notice to the customer. The customer may not transfer the account without written consent.
  2. Delay or failure to enforce a right is not a waiver of it.
  3. If a provision is found unenforceable, the rest of the agreement continues to apply.
  4. Notices to the customer are sent to the account email and shown in the dashboard. Notices to BUL: support@friman.app.
